ELIGIBILITY: The Ultimate Tailgate Gear Giveaway Sweepstakes ("Sweepstakes") is open to legal U.S. residents who are 18 years of age and older. Employees, officers and directors of Dick’s Sporting Goods (“Sponsor”), Promotion Mechanics, Inc. (“Administrator”), their subsidiaries, affiliates, advertising and promotion agencies and the immediate family members (spouses and parents, children and siblings and their spouses, regardless of where they live) or members of the same households (whether related or not) of such individuals (collectively “Sponsor and its agents”) are not eligible. Void where prohibited.
The Sweepstakes begins at 12:01 AM Eastern Time ("ET") on August 24, 2008 and ends at 11:59 PM ET on October 10, 2008 ("Sweepstakes Period").
TO ENTER: Visit www.fanfriday.com, review the Official Rules posted at the website, and indicate that you have read and agree to the Official Rules. Then complete and submit the online entry form and attach a photo of you and your friends/colleagues wearing jerseys from your favorite professional football team. The photo may be in color or black and white, must be only in GIF (.gif) or JPEG (.jpg) format and may not exceed a file size of 4 megabytes. Files exceeding the maximum size will not be accepted. Photo must be the property of the entrant; entrant must know the names and addresses of any identifiable persons in the photo, and must have permission from those persons to submit the photo. Submit your entry so that it is received by Sponsor's server by 11:59 PM ET on October 10, 2008. Once submitted, photos become the sole property of Sponsor and will not be acknowledged or returned. Limit one entry per person/email address.
Note that while submitting a photo is required for entry, the photo itself will not be judged nor will it be used to determine the winner of the Sweepstakes. However, all photos will be screened by representatives of the Sponsor and those that are judged to be appropriate will be posted on the Sweepstakes gallery page for viewing by the general public. Note that it may take up to seven days for a photo to be posted and that the Sponsor reserves the right to not post a submitted photo and may disqualify any entry at any time, if it is determined, in the Sponsor’s sole discretion, that the photo is not appropriate, or, that the entrant has not complied with these Official Rules.
By submitting a photo, the entrant gives permission (and warrants and represents that he/she has obtained all rights necessary to give such permission) to the Sponsor to post entrant’s photo on the World Wide Web, and to otherwise use entrant’s entry in accordance with the requirements of this Sweepstakes and the advertising, promotion, and publicity of the Sweepstakes, and otherwise, as stated in these Official Rules (as solely determined by Sponsor. By submitting an entry, you grant the Sponsor all rights of ownership, reproduction, and use of the photo for any purpose whatsoever without compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-free, worldwide right, in all media (now known or later developed) to assign, use, publish, edit, adapt, modify, alter, reproduce, distribute, broadcast, display, copyright, create derivative works or otherwise exploit the travel secret, for commercial or non-commercial use, and without compensation to the entrant. By submitting an entry, you waive any and all rights you may have to the entry. To the extent you have any rights in the photo, you assign all such rights to the Sponsor by submitting an entry.
By submitting an entry, you warrant and represent that the photo is solely your own original unpublished work, has not been previously entered in any competition or contest or won an award, that you own or otherwise control all of the rights to the photo, and that your entry does not violate any law, regulation, or any right of any third party, including but not limited to rights of copyright, publicity and privacy. Submitting a photo that is copyrighted by another individual will make you responsible for any legal action the legal copyright holder might take against you. Further, photos may not defame any person, living or deceased, or otherwise infringe upon a person's personal or proprietary rights. Submissions that the judges and/or the Sponsor determine, in the sole discretion of either party, contain profane or inappropriate content will result in the disqualification of the entrant. Each entrant is solely responsible for obtaining written permission from all persons other than himself/herself identified in the photo. Winner must furnish proof of such permission upon Sponsor's request. Entrants submitting entries that do not satisfy all requirements set forth in these Official Rules will be automatically disqualified. Entry materials become property of Sponsor and will not be acknowledged or returned.
In the event of a dispute as to the identity of an entrant based on an e-mail address, the entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
RANDOM DRAWING — PRIZE — ODDS OF WINNING: On or about October 17, 2008, the Administrator, an independent judging organization, will conduct a random drawing from among all eligible entries received to award one Grand Prize: an Ultimate Tailgate Gear Package consisting of one of every item in the Dick’s Sporting Goods Tailgate Gear product offering, including two armchairs, two roll top tables, two coolers, a trashcan, a car shade, a canopy, a wind wall, a sport cushion, a propane grill, the Go Plate, a magnetic Koozie, a fathead, eleven team jerseys and team hats from the professional football team of the winner’s choice. The total approximate retail value of the Grand Prize is $2,000. Odds of winning will be determined by the number of eligible entries received. No prize transfer or cash redemption. No prize substitution except by Sponsor due to unavailability in which case a prize of comparable or greater value will be awarded.
Winner will be notified by email, phone, postal mail and/or express mail at Sponsor’s sole discretion. If a potential winner fails to respond within timeframe specified in notification letter, the prize will be forfeited and awarded to an alternate winner. Winner will be required to complete an affidavit of eligibility, liability release and (where legal) publicity release, which must be returned within time period specified in notification letter or an alternate winner may be selected. If a winner is 18 or older, as is required for entry, but not of the age of majority in state of residence, prize will either be awarded in the name of parent or legal guardian, or parent or legal guardian must ratify and sign any and all documents required of winner.
